Re-introduction of an ITS privacy waiver form

The Insolvency and Trustee Service (ITS) is committed to ensuring that an individual’s privacy is maintained whilst they are supported through an insolvency process.

Following a review by the ITS Legal Team, we will be re-introducing an ITS privacy waiver form for those who are supporting people through an insolvency procedure.

The new waiver meets obligations under the Privacy Act 2020 and access for supporting individuals or organisations involved in assisting individuals through the entire insolvency process, from application to discharge from the procedure.

The new waiver will become mandatory for all new privacy waiver applications from 1 January 2024, however the form is available from the website already.

Privacy waivers which have been submitted and approved prior to 31 December 2023 will continue to be recognised as valid, from this date onwards the new form will be required for processing.
